The Vacancies Act
Article 2, Section 2, Clause 2, also known as the Appointments Clause of the US Constitution, gives plenary power to the President to nominate and, with the advice and consent of the Senate, appoint public officials. The Constitution requires the Senate confirm certain officials such as Ambassadors, department heads, and federal judges while laws invest the appointment of inferior officers to the President, courts of law, or heads of departments. This important aspect of the separation of powers functions as a restraint on Congress not to abrogate the control of the President over the executive branch.
